Attorney Martin Garbus announce Wednesday that he has agreed to represent Imus in a wrongful breach of contract suit against his former employer. Imus had $40 million remaining on a multiyear contact that began in 2006 and included a clause that CBS wanted him to be 'irreverent' and 'controversial': "Company (CBS Radio) acknowledges that Artist's (Imus') services to be rendered hereunder are of a unique, extraordinary, irreverent, intellectual, topical, controversial and personal character and that programs of the same general type and nature containing these components are desired by Company and are consistent with Company rules and policies." The contract does provide that CBS Radio may terminate the agreement for "just cause." According to the document, this includes "on-air mention whatsoever by Artist (Imus) of company's officers or directors. Such limitation shall not preclude references to members of station management, so long as such references are not overtly inflammatory or malicious." Based on the observations of the rap artists, it seems to me that Imus wouldn't have been in trouble at all if he'd simply had a backbeat as a bed for his words. And I think it's correct to take this matter to a court to see if there was in fact a breach of contract. I also don't think he's trying to get back on the air as much as trying to obtain the rest of his contract funds so he can keep the ranch running. Finally, if you don't remember who Martin Garbus was, he was on the defense team when obscenity charges were brought against Lenny Bruce. We shall see. --- That's it for now.
